Probable Cause to Stop

A police officer cannot simply pull you over to make an arrest. He or she must have probable cause to pull you over. There must be a good reason to suspect you are driving while intoxicated or breaking another law, such as speeding, swerving, or other evidence of impaired ability. A thorough, experienced defense attorney will investigate the facts to determine whether an officer had probable cause to pull you over.

Challenging the Intoxilyzer and Other Evidence

The outcome of any drunk driving case depends upon the prosecutor's ability to prove you were driving while intoxicated or that your blood alcohol level was .08 or greater. The proof must be beyond a reasonable doubt.

The state may use testimony by the patrol or police officer regarding his observations of your behavior such as slurred speech, clumsiness or confusion. Other evidence which is often used to demonstrate that you were driving drunk are the results of field sobriety tests, blood tests, and breath tests.

An experienced lawyer will challenge each of these pieces of evidence to determine if it was lawfully obtained, properly gathered, and accurate. Recent evident suggests that the Intoxilyzer used by many law enforcement agencies in Minnesota has occasionally printed out different blood-alcohol readings than what was displayed on the machine's screen. Breathalyzer and Intoxilyzer test results can be inaccurate for a number of reasons, including:

  • The breath test was given by someone not properly trained to administer the test
  • The machine was not properly calibrated
  • The microprocessor of the machine is faulty or outdated
  • Other equipment malfunctions or defects in the machine

Field Sobriety Tests

Field sobriety tests are used to provide police and patrol officers with evidence of impaired ability. Unfortunately, they are often administered improperly and the results can be affected by a number of factors other than alcohol consumption. It's important to examine the other factors that may have caused you to fail a field sobriety test and to challenge that evidence in court.
